Intellectual Property & Image Selection

Mainsight Visuals, LLC retains full copyright to all images and video content produced during any session. Clients receive a limited, non-transferable license for personal use and/or non-commercial professional use, unless otherwise agreed upon in writing.

Mainsight Visuals carefully selects, edits, and delivers only the best images and footage from each session, consistent with our artistic standards and professional judgment. Unselected images—including test shots, duplicates, outtakes, or unedited files—are not delivered and may be permanently discarded. RAW or unedited files are not included, as they do not represent the final artistic vision.

Client Usage

Clients may use delivered images for personal purposes or to promote their business or services. Images may not be sold, transferred, sublicensed, altered, or used in a misleading manner. Clients may not claim copyright ownership of any images.

Mainsight Visuals’ Usage Rights

Clients grant Mainsight Visuals, LLC and its service providers a royalty-free, worldwide, irrevocable license to use images and video captured during the session for marketing, advertising, portfolio display, and promotional purposes across all platforms, including websites and social media. The client confirms that no third-party rights restrict this use.

Photo Credit

When images are shared publicly online, proper credit to Mainsight Visuals is required where reasonably possible.

Results & Expectations

While every effort is made to accommodate client requests, specific poses, expressions, moments, or outcomes are not guaranteed. Results may vary due to factors beyond the photographer’s control, including lighting conditions, weather, venue limitations, subject cooperation, or decor.

Cooperation & Timing

Clients are responsible for arriving on time and ensuring readiness for the scheduled session. Delays caused by the client may reduce coverage time and do not entitle the client to a reduced fee or extended session. The photographer will use professional judgment and expertise to achieve the best possible results.

Cancellations & Retainers

All retainers are non-refundable once work has been scheduled or initiated. If the client cancels prior to the session, any future payments will be canceled, but the retainer will be forfeited.

Permits & Location Access

Clients are responsible for obtaining any required permits, permissions, or approvals for the chosen location. Mainsight Visuals, LLC is not responsible for issues arising from failure to secure proper access or authorization.

Photographer Safety

If the photographer encounters unsafe, hostile, or inappropriate behavior, the session may be terminated immediately at the photographer’s discretion. All payments made up to that point will be forfeited, and no refunds will be issued.
