Terms of Service

1. Intellectual Property & Deliverables

Mainsight Visuals, LLC retains full copyright ownership of all photographs, video content, footage, audio recordings, and other media created during any session or project.

Clients receive a limited, non-transferable license to use the final delivered images and videos for personal use and approved business or promotional use unless otherwise agreed upon in writing.

Mainsight Visuals carefully selects and edits the best images and footage based on our artistic standards and professional judgment. Not every image or clip captured during a session will be delivered.

RAW files, camera originals, project files, working files, and unedited files are not included unless specifically agreed upon in writing.

2. Client Usage

Delivered media may be used for personal use, business websites, social media, marketing, and promotion of the client's own business, brand, organization, or event.

Media may not be sold, transferred, sublicensed, submitted for artificial intelligence training, or provided to another business, vendor, publication, or third party for separate use without prior written permission from Mainsight Visuals, LLC.

Clients may not alter, edit, manipulate, AI-enhance, or authorize any third party to alter or edit Mainsight Visuals' delivered images or videos without prior written permission from Mainsight Visuals, LLC.

Clients may not claim copyright ownership of any media created by Mainsight Visuals, LLC.

3. Payments, Retainers & Cancellations

A 50% non-refundable retainer is required to reserve your appointment and remove your selected date and time from availability. The retainer is earned upon booking and is non-refundable if you cancel, fail to appear, or arrive more than 30 minutes late without prior approval.

The remaining balance is due before final images, videos, or other deliverables are released unless otherwise agreed upon in writing.

Rescheduling is subject to availability and may require an additional fee.

4. Session Responsibilities

Clients are responsible for arriving on time and ensuring that all participants, locations, permits, permissions, parking, access, and any required approvals are secured before the scheduled session.

Late arrivals, lack of preparation, restricted access, or delays caused by the client or venue may reduce available coverage and do not entitle the client to additional time, reduced fees, refunds, or complimentary rescheduling.

If Mainsight Visuals encounters unsafe, threatening, illegal, or inappropriate conditions or behavior, services may be paused or terminated immediately. Any payments earned up to that point remain non-refundable.

5. Results & Limitations

Mainsight Visuals will make every reasonable effort to accommodate client requests while maintaining professional and artistic standards.

Specific poses, expressions, moments, lighting conditions, weather, venue conditions, social media performance, business results, sales, bookings, or any other outcome cannot be guaranteed.

6. Mainsight Visuals Usage Rights

Unless otherwise agreed upon in writing, the client grants Mainsight Visuals, LLC permission to use photographs, videos, still frames, and behind-the-scenes content created during the session for portfolio display, website content, social media, advertising, marketing, studio samples, competitions, publications, and other promotional purposes.

7. General Terms

Mainsight Visuals shall not be liable for delays or inability to perform services due to circumstances beyond reasonable control, including severe weather, illness, equipment failure despite reasonable maintenance, government restrictions, venue closures, transportation disruptions, or other unforeseen events. Reasonable efforts will be made to reschedule services when practical.

If a signed client agreement, proposal, invoice, or other written agreement conflicts with these Terms of Service, the signed agreement will govern that specific project.
